Live-in Care Direct is a platform for connecting persons who are looking to engage self-employed professional carers to provide live-in care (the "Customer"), and self-employed care professionals that are part of Live-in Care Direct’s network of Carers (the "Carer"). The Company checks the backgrounds of each Carer via third party background check services; however, the Company does not guarantee or warrant, and makes no representations regarding, the reliability, quality or suitability of the Carer. It is solely the responsibility of each Customer, and not the Company, to determine whether they are qualified and capable. Even when accurate, reference checks do not necessarily predict future behaviour of a Carer. When you book a Carer, you should ensure that you use common sense and caution to ensure protection of you and others’ personal property and safety, including by supervising the Carer as you would supervise anyone who provided a service to you that you did not know. The Company will not be liable, to the extent permitted by law, for any claim, injury or damage arising in connection with your use of the Live-in Care Direct Platform and the Company is not responsible for the conduct, whether online or offline, of any user of the Live-in Care Direct Platform. The Carer must have minimums breaks of 2 hours per day within daylight hours. At the request of the Carer, it is permissible for these breaks to be banked to provide a longer individual break but the minimum duration is 14 hours over 7 days; and sanitary living conditions, which include (i) a separate bedroom and suitable bathing and toilet facilities; (ii) clean bedding and (iii) provision of ample food. In respect of (iii), we recommend a minimum sum of £30 per week for the cost of the Carer's food. Live-in Care Direct does not provide Care to Care Seekers nor do we employ or supply Care Givers. Our Services allow Users to connect only and Live-in Care Direct shall not be a party to any agreement between a Care Giver and Care Seeker for the provision of Care. For Value Added Tax (“VAT”) purposes Live-in Care Direct are acting as a disclosed agent, independent of both the Care Givers and the Care Seekers. Live-in Care Direct is a provider of technology platform services only, the Platform. We do not provide Care nor are we responsible for managing, directing or overseeing the provision of Care provided by Care Givers nor the conduct of Care Seekers (including, but not limited to, failure or refusal to pay for Care received). We are a disclosed agent allowing for Care Givers to advertise their services on the Platform. The Company use our reasonable endeavours to undertake checks of Care Givers and they will not be allowed to advertise their provision of care services on the Platform until they have satisfied such checks. However, we provide no guarantee as to character, capability or suitability of Care Givers. Background checks are undertaken on our behalf by a specialist provider and we are not responsible for the accuracy and completeness of the checks which are undertaken. The Company do not undertake any background checks of Care Seekers nor complete risk assessments of their home environments nor undertake any planning of the Care to be provided and we are not responsible for any injury sustained by a Care Giver in the course of providing Care to a Care Seeker. The Company shall not be a party to any agreement for the provision of Care by a Care Giver to a Care Seeker and any such agreement shall between the Care Giver and Care Seeker and any other third party (or third parties) as the parties may agree. Nothing contained in these Terms shall render the relationship of the Care Giver to the Company as that of an employee, worker, agent or partner and the Care Giver shall not hold him or herself out as such. Care Givers acknowledge that any Care provided by them to any Care User is provided on the basis of a direct engagement by the Care Seeker.
When you make a booking, the Company will help facilitate the transaction by providing a mechanism for paying amounts due in connection with each Carer. Fees for Carers are non-refundable and will be charged to you in accordance with the Company's pricing schedule in force at the time, which the Company may update from time to time on a going-forward basis. The Customer is liable for any and all taxes (other than taxes based on the Company's income) related to the Carer. The Company will charge the Customer for Carers through the payment method specified in your account (e.g. a credit card, debit card or direct debit).
Client must complete 4 weeks care with us before payment is issued to the introducer.
